New Form I-9 Now Available
USCIS has released the new Form I-9. Per our previous post, the form has undergone some welcome adjustments to include;
• Sections 1 & 2 combined into one page.
• “Section 3” has been separated from Sections 1&2 and been renamed “Supplement B Reverification and Rehire” which only needs to be retained in the event it applies.
• The Preparer and/or Translator Certification has also been separated from Section 1. The previous requirement to check a box, even if a preparer is not used, no longer applies. The separate “Preparer and/or Translator Certification”, now labeled “Supplement A”, is now only required if a preparer and/or translator was used.
• A checkbox has been added to Section 2 to indicate if the “alternative procedure”, which permits the remote review of documents for qualifying employers, was used.
• The list of acceptable documents has been updated to acknowledge documents that have been automatically extended and receipts.
Employers may start using the new version of the Form I-9 beginning August 1. USCIS, however, offers a 90-day transition period to continue using the previous version of the Form. Beginning November 1, 2023, only the new Form I-9 dated “08/01/2023” (found in the lower left corner) may be used.
