USMCA Joint Review Begins: What It Means for TN Visas
The first Joint Review of the United States-Mexico-Canada Agreement (USMCA) begins today, marking the start of the formal review process established under the agreement. Because the TN visa classification is part of the USMCA framework, the review has prompted questions from employers and Canadian and Mexican professionals who rely on the program.
The Joint Review also comes amid renewed public attention following President Trump’s June 30 comments that he is “not looking to renew” the agreement. While those remarks have fueled speculation about the future of the USMCA, the Administration has not announced a formal proposal affecting the agreement or the TN visa classification.
Most importantly, there have been no changes to the TN visa program, eligibility requirements, or application procedures.
What the USMCA Joint Review Means for TN Visas
The Joint Review is the beginning of a process—not an immediate decision on the future of the agreement. If the United States, Canada, and Mexico do not agree to extend the USMCA, the agreement does not automatically terminate. Instead, it remains in effect while the parties continue negotiations through annual reviews.
Many business organizations view the Joint Review as an opportunity to modernize the agreement while preserving the benefits of an integrated North American economy. Canada and Mexico have both expressed support for maintaining the USMCA, and they are joined by numerous U.S. business organizations—including the U.S. Chamber of Commerce and coalitions representing manufacturers, agricultural producers, retailers, and other industries—which have advocated for preserving a stable North American trade framework while pursuing targeted updates.
At the same time, because the TN classification is tied to the USMCA, employers and foreign nationals should continue to monitor developments. No proposals affecting TN visas have been announced, and any changes to the program would likely occur, if at all, only after an extended review and negotiation process.
Current Status of the TN Visa Program
There has been no change to the availability of TN visas or the rules governing current TN visa holders.
Employers may continue to hire qualified Canadian and Mexican professionals in TN status, and individuals may continue to apply for new TN visas and extensions under the existing requirements.
There has also been no announcement affecting existing TN approvals, pending applications, or current filing procedures.
What Employers Should Do
At this stage, employers should be aware of the Joint Review process but should not assume changes to the TN visa program are imminent.
Organizations that rely on TN professionals should continue normal hiring and extension practices while monitoring future developments as negotiations progress. That said, employers may wish to explore other visa options for current TN employees and for new hires.
Guidance for Current TN Visa Holders
Current TN visa holders remain authorized to work under the terms of their existing status. Individuals should continue to maintain valid immigration status and consult immigration counsel before changing employers or making significant international travel plans.
