Haitian TPS Extended Through July 27 Following Federal Court Order

The scheduled termination of Temporary Protected Status (TPS) for Haiti on July 23, 2026 has been temporarily delayed. On July 22, 2026, the U.S. District Court for the District of Columbia issued an order in Miot et al. v. Trump et al., extending current TPS protections for Haitian beneficiaries through July 27, 2026 while the litigation continues.

The extension is temporary and does not represent a final decision regarding the future of Haiti’s TPS designation. Additional court action or government announcements are expected in the coming days.

The State of Haitian TPS As Of July 22, 2026

  • Haitian TPS beneficiaries remain authorized to work through July 27, 2026, subject to any subsequent court order or government action.
  • Employers should continue monitoring developments before making employment eligibility decisions based on the previously announced July 23 termination date.
  • Additional guidance may be issued by DHS or USCIS if the litigation results in a further extension or the termination is permitted to take effect.
