DHS Announcement: Renewed Focus on Existing Alien Registration Requirements

On February 25, 2025, the Department of Homeland Security (DHS) reiterated its commitment to enforcing the longstanding alien registration requirement under Section 262 of the Immigration and Nationality Act (INA) (8 U.S.C. 1302). This requirement has been in place since 1940 and therefore not a new law or policy change. DHS did announce plans for an online registration system, which will be introduced at a future date.

Who Is Already Registered?

Lawfully present foreign nationals are already registered. This includes:

  • All U.S. visa holders (nonimmigrant and immigrant visas). 
  • Deferred Action for Childhood Arrivals (DACA) recipients.
  • Temporary Protected Status (TPS) holders.
  • Applicants for Adjustment of Status (green card applicants).
  • Employment Authorization Document (EAD) holders.
  • Other lawfully present individuals who complied with immigration entry and documentation requirements.

An important reminder for registered individuals is the longstanding requirement to submit an AR-11 Change of Address Form within 10 days of moving to ensure compliance.

Who Must Register?

  • Those who entered the U.S. without inspection and have not provided required biometric information.
  • Those who were registered as minors under age 14 but did not re-register upon turning 14.
  • Foreign nationals who overstayed a period of authorized stay and never completed the alien registration process.
  • Canadian citizens who entered as visitors at land ports of entry and who were not issued evidence of registration.  

What, If Anything, Needs to Be Done?

For those who are lawfully present, no immediate action is needed beyond ensuring address updates are filed as required. If you are uncertain about your registration status, reviewing your immigration records or consulting a legal professional may be helpful.
