Immigration Executive Action Remains in Limbo as Court Denies Government’s Emergency Stay

In a court order issued May 26, 2015, a divided panel of the Fifth Circuit Court of Appeals denied the Federal government’s request for an emergency stay on a preliminary injunction that has halted President Obama’s Executive Action regarding deferred action. Last November, President Obama announced several initiatives, including Deferred Action for Parents of Americans and Lawful Permanent Residents, (DAPA) as well as an extension of the Deferred Action for Childhood Arrivals (DACA) program that has been in place for almost three years. Although the emergency appeal was denied, the Court is still considering the government’s appeal of the previous decision to grant a preliminary injunction which is preventing the government from accepting any DAPA applications and will hear arguments in July. The case itself, initially filed in the District Court in Texas, is in the early stages of discovery.
