Automatic Extension for Green Card Renewals Increased to 24 Months

In recognition of the extraordinary long wait times experienced by individuals filing Form I-90 to renew an expiring Green Card, USCIS announced that they have increased the automatic extension of validity of the Green Card from 12 months to 24 months.  While notices for newly filed Forms I-90 will include this updated extension, USCIS will also be issuing amended receipt notices for those with a pending I-90.

The combination of the expired green card and the notice indicating the extension of the green card’s validity date is considered acceptable List C evidence of employment authorization.  If this combination is presented to satisfy the Form I-9, the employer must reverify prior to the end of the extension period. In addition, presentation of the expired green card and the receipt notice, while valid, may be used to re-enter the U.S.
