USCIS Announces Termination of TPS for Yemen

The Department of Homeland Security (DHS) has announced the termination of Temporary Protected Status (TPS) for Yemen, according to a notice released by U.S. Citizenship and Immigration Services (USCIS). TPS for Yemen will terminate on May 4, 2026.

What Employers Should Know

Employers may not know which employees are from Yemen or currently relying on TPS-related work authorization. As a result, the key compliance step is to carefully monitor work authorization expiration dates recorded on Form I-9.

  • Employees whose Employment Authorization Documents (EADs) are tied to Yemen TPS may lose work authorization after May 4, 2026, unless they obtain another valid status or employment authorization.
  • Employers must reverify employment authorization in Section 3 of Form I-9 no later than the expiration date listed for the employee’s work authorization.

E-Verify Employers

Employers enrolled in E-Verify should also regularly review the Status Change Report, which identifies certain employees whose employment authorization may have changed based on DHS updates. Regular review of this report can help employers identify situations where reverification may be needed.

Practical Takeaway

Rather than focusing on nationality, employers should maintain strong I-9 tracking and reverification practices, monitor expiring work authorization documents, and review E-Verify reports where applicable to remain compliant.
